Terms of Service

1. Operator and scope

BlueProprty is a brand and quiz platform owned and operated by BlueSystm. In these quiz terms, “we,” “us” and “our” refer to BlueSystm operating BlueProprty, not an independent contractor. BlueSystm provides marketing and software tools for preliminary home-improvement planning. Neither BlueProprty nor BlueSystm performs, manages, supervises or guarantees construction work through this quiz, or acts as your contractor, installer, engineer, inspector, insurer or government rebate administrator.

These terms concern the quiz, its preliminary pricing information, project summaries and related outputs, including a quiz displayed on an independent contractor's site or reached through an advertisement. They are not terms for all other BlueSystm products. A contractor-branded experience identifies the contractor separately; “Powered by BlueProprty” identifies BlueSystm's technology, not a construction partnership, warranty or endorsement. The contractor does not gain authority through the quiz to enter into commitments on BlueSystm's behalf.

2. Estimates, starting prices and rebates

Every quiz result is an approximate budget indication only: not an exact estimate, binding quote, fixed or maximum price, offer to perform work, or construction contract. The labels “estimate,” “your price,” “from,” a price range or an itemized total do not change this limitation. The same applies to a result displayed on screen, downloaded, sent by SMS or PDF, or repeated by an automated assistant. Completing the quiz, requesting a result or accepting contact permissions does not hire a contractor, reserve work or materials, require a purchase, or authorize a charge.

Prices, including “from” prices, are illustrative planning information, not a binding quote, guaranteed saving, offer to perform work or promise that a contractor will accept the project. An estimate depends on the information supplied, location, measurements, thickness, chosen materials, labor, preparation, demolition, disposal, access, permits, taxes, structural conditions and market availability. Items may be excluded unless specifically listed.

The quiz uses limited answers and assumptions rather than a site inspection, verified measurements or a professional design. Images and diagrams are illustrative and do not specify the exact material, finish, quantity, layout or scope you will receive. Unseen damage, moisture, mold, asbestos, electrical or structural issues, ground conditions, drainage, code requirements and other conditions may materially change the work and price. A final contractor price can be higher or lower than the displayed amount or range; the range is not a guaranteed ceiling or floor.

A contractor must confirm the scope, site conditions, measurements, inclusions, exclusions, schedule and final price in a written proposal. Material prices and rebate rules can change. Verify eligibility, funding availability, required approvals and application deadlines with the relevant program; no rebate or financing approval is guaranteed.

Do not order materials, start work, pay a deposit or make financing or safety decisions solely from a quiz result. Obtain an independent written proposal and any required inspections first. A quiz result does not obligate a contractor to honor its amount. A separate valid contractor agreement may establish binding obligations; these quiz terms do not cancel or override those obligations. Suspected input, calculation or display errors should be reported and checked before reliance. Correcting a preliminary result does not authorize misleading advertising or retroactive changes to an already binding agreement.

3. Your information and requests

Use the service only for lawful purposes and provide information you are authorized to provide. Contact requests are intended for adults aged 18 or older who are the subscriber or authorized user of the supplied phone number. Do not submit another person's number without authority.

At the final step, the notice next to the submission area explains that selecting “Text my estimate” accepts these BlueProprty Terms & Conditions and acknowledges the Privacy Notice. If you do not agree, do not submit; you may leave the quiz. You can save or print these terms from your browser. Merely opening a link is not acceptance. This agreement concerns use of the quiz, not the purchase of construction services.

The separate, initially unchecked estimate SMS choice requests only the estimate from the named sender. On the BlueProprty website, that sender is BlueSystm operating BlueProprty. Neither acceptance of these terms nor an estimate request authorizes unnamed contractors to contact you. Optional marketing texts and calls require their own affirmative acceptance after the Marketing consent disclosure is displayed. Marketing consent is not a condition of purchase or receiving an estimate. See the communication terms. This preview records temporary demonstration choices only and does not activate contact permissions or transmissions.

4. Independent contractors

A contractor is responsible for its proposals, sales practices, licenses, insurance, workers, permits, code compliance, safety, materials, workmanship, warranties and performance. Verify these items directly before hiring. A listing or estimate does not by itself represent that BlueProprty has checked qualifications, guarantees availability or endorses a contractor.

BlueSystm is not a party to the construction agreement and does not undertake the contractor's performance obligations merely by providing the quiz, introducing a contractor or transmitting information. Workmanship, property damage, delays, deposits, collections and other project disputes should be addressed with the responsible contractor. This allocation does not remove BlueSystm's responsibility for its own conduct where applicable law imposes it.

Payments, deposits, cancellations, liens, project changes and construction warranties must be addressed in your separate contractor agreement and applicable law. BlueProprty's platform terms do not replace legally required home-improvement contract disclosures or cancellation rights.

5. Marketing relationships

BlueProprty may offer marketing or software services to contractors. Before any live referral or paid placement is introduced, the relevant experience must disclose who receives your request, any relevant paid placement or commercial relationship, and how the information will be used. This draft does not authorize undisclosed distribution of a request or resale of messaging consent.

The quiz does not promise a particular number of contractor responses, customer leads, appointments, conversions, projects, revenue, savings or return on advertising spend. Contractor subscription, advertising, pricing-approval, service-level and commercial liability obligations belong in a separate agreement between BlueSystm and that contractor. A visitor's acceptance cannot substitute for the contractor's agreement.

6. Automated assistance

Any future AI assistant should identify itself and the business it represents. Automated answers may be incomplete or incorrect; confirm project specifications, prices, safety matters and contractual commitments with the contractor. Do not use the service for emergencies.

7. Acceptable use and content

BlueSystm owns the BlueProprty brand and the original quiz software, designs, templates, calculation tools and content in which it holds intellectual-property rights. Third-party software, licensed assets, contractor trademarks and user-supplied content remain subject to their owners' rights and applicable licenses. A contractor's branding or payment for a service does not by itself transfer ownership of BlueSystm's platform or templates. Any transfer or broader license must be expressly agreed in writing by the relevant rights holder.

You may use the quiz for lawful project planning and keep or share your own project summary with an adviser or contractor. This permission does not allow resale of the platform, unauthorized copying of its protected code or templates, removal of ownership notices, fraudulent submissions or interference with the service. Nothing claims ownership of your personal data, project information or honest reviews, or limits rights that cannot lawfully be restricted.

8. Availability and responsibility

Information is provided for general planning. We do not promise uninterrupted availability or error-free estimates. Any warranty exclusions or limitations apply only to the extent allowed by law. Nothing here excludes non-waivable consumer rights or liability that the law does not allow to be excluded, or excuses a party's own unlawful conduct.

To the extent permitted by applicable law, the quiz and its preliminary outputs are provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose or accuracy of the predicted project cost. To that same extent, BlueSystm disclaims liability for indirect, incidental, special or consequential loss, lost profits or business opportunities arising from use of the quiz or reliance on its preliminary outputs. These limitations apply to the quiz service only and may not apply to you under your state's law.

No clause releases liability for fraud, intentional misconduct, gross negligence, personal injury or other liability to the extent it cannot lawfully be excluded; waives mandatory consumer remedies; prevents a lawful complaint, honest review or report to a regulator; or guarantees immunity from a claim. Describing BlueSystm as a marketing platform does not excuse misleading claims or its own legal duties. If a provision is unenforceable, it applies only to the extent lawfully permitted and does not eliminate mandatory protections.

Disputes are subject to applicable law and the courts with lawful jurisdiction, including any mandatory protections available where you reside. These terms do not require arbitration, waive class proceedings, shorten statutory claim periods or require you to give up a non-waivable remedy. You may contact us to seek a resolution without giving up the right to use a court or regulator. An invalid provision does not invalidate the remaining lawful provisions.

9. Updates and contact

Material changes will be dated and disclosed before applying to new requests. A later policy change does not retroactively alter a submitted request, expand an earlier marketing consent or amend an independent construction agreement; new purposes or senders require the appropriate new authorization.
